"The Bachelor" & Jared Jewelers Present “Marry Me Monday” Casting Call (the "Promotion")

You and your partner must each be at least 21 years of age, legal US residents, and involved in a long-term, committed relationship which you realistically envision will lead to marriage or a civil union in the near future. DO NOT SUBMIT AN APPLICATION IF YOU ARE NOT CONFIDENT THAT YOUR PARTNER SHARES YOUR VIEWS ABOUT THE FUTURE AND NATURE OF YOUR RELATIONSHIP.

You understand and agree that ABC and/or its representatives may contact the references you supply in your application to discuss your possible proposal and your relationship with your partner. Please confirm that your references are willing to speak with ABC prior to submitting their contact information.

You grant ABC, The Bachelor (the “Program”), Sterling Jewelers Inc. and their affiliated entities the right to use your application (or any part thereof) and your name, photograph, likeness and biographical information in any manner and in any media in connection with the Promotion, the Program and/or ABC, including without limitation as part of a commercial tie-in with Sterling Jewelers Inc.

Should ABC choose to give your application further review, you must agree to and fully cooperate with a background check. In addition, you will be required to sign additional documentation as requested by ABC including, without limitation, background authorizations and a Release and Grant of Rights, all in the form provided to you. Failure to complete and sign any such form will end consideration of your application (but will not affect any rights you have previously granted).

You agree to release and forever discharge ABC and Sterling Jewelers Inc., and their respective affiliated companies, entities and persons (collectively the “Released Parties”), from and against any claim or action of any kind relating to your application for or participation in the Promotion or Released Parties’ use (or non-use) of any of the rights granted herein.

You acknowledge that ABC, Sterling Jewelers Inc. and their affiliated companies are in the business of developing new stories, program formats, and other creative materials and that materials developed independently by such entities might be similar or identical to elements of your application or personal experiences. You further agree that any claims relating to any such alleged similarities are explicitly included within the matters released hereunder and that you will not be compensated in connection with your submission.

You agree to defend, indemnify and hold the Released Parties harmless from and against any liabilities or expenses (including reasonable attorneys’ fees) arising out of: (1) any actual or threatened breach of any representation or undertaking made by you in this Agreement or otherwise in connection with the Promotion; (2) any false or misleading statement or representation made in your application or otherwise in connection with the Promotion; (3) your preparation for, participation and appearance in or voluntary withdrawal and/or elimination from the Promotion; and (4) Released Parties’ use of any of the rights you have granted herein.

You understand and agree that ABC has no obligation to proceed with the Promotion and may cancel or discontinue the Promotion for any reason and at any time.

You understand and agree that ABC’s decisions regarding your application are final and binding.
